If you were covered by a Blue Cross Blue Shield health insurance plan at any point between 2008 and 2020, payments from a major class action settlement are now on their way. The case has been resolved, all appeals are done, and the initial distribution of funds is set to begin in May 2026. Here is everything you need to know about who qualifies, how much you might receive, and what to do next.

What Is the Blue Cross Blue Shield Settlement?

The settlement stems from a class action lawsuit filed in 2013 against more than 35 Blue Cross Blue Shield health insurance plans. The lawsuit alleged that the Blue Cross Blue Shield Association and its member plans violated antitrust laws by agreeing not to compete with each other and by limiting competition in the health insurance market. The plaintiffs argued this arrangement led to higher premiums and fewer choices for customers.

Blue Cross Blue Shield has repeatedly denied all allegations of wrongdoing and did not admit to any misconduct as part of the settlement. The court did not reach a final verdict on the merits of the case. However, both sides agreed to settle in October 2020 to avoid the cost and uncertainty of further litigation. The settlement established a $2.67 billion Settlement Fund and also requires the Settling Defendants to make changes to how they conduct business going forward.

Who Is Eligible for a Payment?

Eligibility falls into two distinct groups, each with its own coverage period.

However, eligibility alone is not enough. You must have filed a claim by 5 November 2021 to receive any payment. Approximately 6 million eligible class members filed claims ahead of that deadline. If you did not file by the deadline, you will not receive a payment regardless of whether you were covered during the relevant period.

How Much Will Payments Be?

The total settlement fund is $2.67 billion. However, after deducting attorney fees, administrative expenses, and other costs, approximately $1.9 billion remains available for distribution to claimants.

With around 6 million claims filed, the expected average payment is approximately $333 per claim. The actual amount you receive may vary depending on a few factors, including whether your insurance plan was fully insured or self-funded, and the total premiums or administrative fees paid during the covered period.

It is also confirmed that claims worth less than $5 will not result in a payout.

When Will Payments Be Sent?

The initial distribution of payments to eligible claimants will begin in May 2026. The court has resolved all outstanding appeals and the settlement is now final. The claims administrator is currently reviewing claims and sending out determination notices by email and postcard on a rolling basis.

If you filed a claim, you should already have received or be receiving a claim determination notice. Check your email and physical mailbox for correspondence from the settlement administrator. Follow the instructions provided in that notice carefully to ensure your payment is processed correctly.
