Just one year after the beloved The Cosby Show actor drowned while on holiday in Costa Rica, his widow, Tenisha Warner, has filed a lawsuit against his mother, Pamela Warner, alleging that more than $1.2 million remains unpaid under the couple’s prenuptial agreement.
According to CNN, the legal dispute comes after what Tenisha Warner says was a year-long effort to privately resolve the late actor’s estate while honoring his wishes. The lawsuit, filed on Monday in DeKalb County Superior Court in Decatur, Georgia, names Pamela Warner in her role as the successor trustee of the Warner family trust.

Malcolm-Jamal Warner died on July 20, 2025, at the age of 54, following a drowning accident while vacationing in Costa Rica. His wife, whom he intentionally kept out of the public spotlight during his lifetime, is now seeking at least $1,276,042.46, plus interest, attorney’s fees and court costs.
According to the lawsuit, Warner and Tenisha married on May 23, 2022, after signing a prenuptial agreement on May 15, 2022. They also share a daughter, whose identity has never been publicly disclosed.

The lawsuit alleges that Malcolm-Jamal Warner had agreed to maintain a $1 million term life insurance policy naming his wife as beneficiary but never obtained the policy.
In addition, the complaint claims he failed to fulfill several financial commitments outlined in the prenuptial agreement, including:
- Annual $16,000 anniversary payments, which the lawsuit calculates now total $50,542.46.
- Maximum yearly contributions to a Roth Individual Retirement Account for his wife.
- A promised $5,000 monthly salary for Tenisha Warner’s work as his chief of staff, amounting to $195,000.
The filing states that all of these obligations were reflected in the signed prenuptial agreement attached to the lawsuit.

Widow says she tried to settle matters privately
In a statement provided to CNN by her attorney, Tenisha Warner said she spent the past year attempting to resolve the estate without litigation.
She said Malcolm-Jamal Warner “had every intention” of providing for both her and their nine-year-old daughter, adding that he had been working on replacing an estate plan originally drafted in 1996, when he was just 26 years old, decades before they met or started a family together.
“Sadly, he was unable to do so before we lost him. I have been struggling to care for our daughter as a single mom and now as her sole provider,” she said, explaining that legal action became necessary before any potential statute of limitations expired.
CNN reported that it has reached out to Pamela Warner for comment.

Writing alongside family photographs, she said: “I can still hear my husband’s laugh, still feel the way he made room for every part of me — every tear, every dream.”
On the one-year anniversary of his death, Pamela Warner also shared an emotional message on her son’s memorial Instagram account.
“It is the parent that leaves first and leaves the child/children to continue on with their lives. But what do you do when this is out of order and the child/children leave first?” she wrote.
Reflecting on the painful milestone, she added: “How can I be here and my child is not?”
